Terms and conditions of use
1. SCOPE OF APPLICATION
1.1 These General Terms and Conditions of Sale (hereinafter referred to as the "GTC") apply, without restriction or reservation, to all sales concluded by MANON MERGNAT, 34 rue Averroes, 34170 Castelnau le Lez – SIRET: 89400568500033
(hereinafter "Manon Mergnat") to non-professional physical buyers (hereinafter "Customers" or "Customers"), wishing to purchase the products offered for sale (hereinafter "Products") by Manon Mergnat on the website https://www.manonmergnat.com (hereinafter "the Website").
The main characteristics of the Products, including specifications, illustrations, and indications of dimensions or capacities, are presented on the Website, which the Customer is required to read before ordering. 1.2 The selection and purchase of a product are the sole responsibility of the Customer.
1.3 Product offers are subject to availability, as specified when the order is placed.
1.4 These General Terms and Conditions are accessible at any time on the Website https://www.manonmergnat.com and shall prevail over any other document.
1.5 The Customer declares that they have read and accepted these General Terms and Conditions by checking the box provided for this purpose before initiating the online ordering process on the Website.
1.6 These general terms and conditions may be modified at any time and without notice by Manon Mergnat. The applicable conditions shall be those in effect on the date of the Customer's order.
1.7 Unless proven otherwise, the data recorded in Manon Mergnat's computer system constitutes proof of all transactions concluded with the Customer.
2. ACCOUNT
2.1 To place an order, the Customer is invited to create an account (personal space).
To do so, the Customer must register by completing the form provided when placing the order and agrees to provide truthful and accurate information regarding their marital status and contact details, including their email address.
The Customer is responsible for updating the information provided. They are informed that they can modify it by logging into their account.
2.2 The Customer can modify their data in the "My Account" section and view their order history.
2.3 The Customer may also request to unsubscribe by visiting the dedicated page in their personal space or by sending an email via the contact page. This will be effective within a reasonable timeframe.
2.4 In the event of non-compliance with the general terms and conditions of sale and/or use, Manon Mergnat may suspend or even close a Client's account after formal notice has been given electronically and without effect.
Any account deletion, regardless of the reason, results in the outright deletion of all the Client's personal information.
2.5 Manon Mergnat shall not be liable for any event due to force majeure resulting in a malfunction of the Website or server, subject to any interruption or modification during maintenance.
2.6 The creation of an account constitutes acceptance of these general terms and conditions of sale.
3. PRICES
3.1 The Products are provided at the current prices listed on the Website when Manon Mergnat places the order.
3.2 Prices are expressed in Euros, net of VAT (VAT not applicable under Article 293B of the French General Tax Code (CGI)). These prices do not include processing, shipping, transport, and delivery fees, which are charged in addition, under the conditions indicated on the Website https://www.manonmergnat.com and calculated prior to placing the order.
The payment requested from the Customer corresponds to the total amount of the purchase, including these fees.
3.3 An invoice is issued by Manon Mergnat and sent to the Customer via their personal account.
3.4 The prices take into account any discounts that may be granted by Manon Mergnat on the Website.
These prices are fixed and cannot be revised during their period of validity, but Manon Mergnat reserves the right to modify the prices at any time outside the period of validity.
4. ORDERS
4.1 It is the Customer's responsibility to select the Products they wish to order on the Website, after creating their account.
Product offers are valid as long as they are visible on the Website, while stocks last.
4.2 The sale will only be considered valid after full payment. It is the Customer's responsibility to verify the accuracy of the order and to immediately report any errors.
4.3 Any order placed on the Website constitutes the formation of a distance contract between the Customer and Manon Mergnat.
4.4 Manon Mergnat reserves the right to cancel or refuse any order from a Customer with whom there is a dispute regarding the payment of a previous order.
4.5 The Customer may track the progress of their order on the Website.
4.6 The Customer is informed on the product sheets in the "Order" category that the Products must be completed before being shipped and agrees to the delivery time indicated on the homepage.
4.7 The Customer is informed that custom artwork cannot be canceled once paid for and placed. It is the Customer's responsibility to carefully consider their order before placing it.
5. PAYMENT
5.1 The Customer must pay for their order in full on the day it is placed. They can pay by credit card (Visa, Eurocard/Mastercard) or with their PayPal account.
5.2 Payment data is exchanged in encrypted mode using the protocol defined by the authorized payment service provider for banking transactions carried out on the Website.
5.3 Payments made by the Customer will only be considered final after Manon Mergnat has actually collected the amounts due.
Manon Mergnat will not be required to deliver the Products ordered by the Customer if the latter does not pay the price in full under the conditions indicated above.
6. DELIVERY
6.1 The Products ordered by the Customer will be delivered within mainland France and the European Union. Upon request, they can be delivered to any country.
If the Products ordered have not been delivered within 7 business days after the estimated delivery date, for any reason other than force majeure or the Customer's actions, the sale may be terminated at the Customer's written request under the conditions set out in Articles L 216-2, L 216-3, and L 241-4 of the French Consumer Code. The amounts paid by the Customer will then be returned to them no later than fourteen days following the date of termination of the contract, excluding any compensation or deduction.
Deliveries are made by post to the address provided by the Customer when ordering, which the carrier will have access to. The Customer must ensure that they have provided accurate and complete information regarding the delivery address (such as, but not limited to: street number, building number, stair number, access codes, names and/or intercom numbers, etc.). Deliveries cannot be made to hotels or PO boxes. The delivery times indicated on the website are indicative, corresponding to average processing and delivery times.
The Customer is required to check the condition of the delivered products. They have 3 days from delivery to notify Manon Mergnat by any means possible.
Manon Mergnat cannot be held responsible for the consequences of a delivery delay not caused by its fault.
7. TRANSFER OF OWNERSHIP
7.1 The transfer of ownership of MANON MERGNAT STORE Products to the Customer will only take place after full payment of the price by the latter, regardless of the delivery date of said Products.
8. RIGHT OF WITHDRAWAL
8.1 The right of withdrawal may be exercised online via a form available in the Customer's order history and may be exercised within fourteen (14) days of receipt of the order.
Returns must be made in their original and complete condition, allowing them to be resold as new, accompanied by the purchase invoice.
Damaged, soiled, or incomplete Products will not be accepted.
Return shipping costs are the responsibility of the Customer.
Custom orders are not subject to the right of withdrawal.
9. PRODUCTS AND COMPLIANCE
9.1 The Products offered by Manon Mergnat are presented on the Website and include a complete product sheet detailing the various characteristics of the Product.
The Products offered by Manon Mergnat comply with the standards applicable in France.
9.2 The Customer is also informed that despite all precautions taken, some products may contain cat hair.
10. INTELLECTUAL PROPERTY
10.1 The content of the Website (https://manonmergnat.com) is the property of Manon Mergnat and is protected by French and international intellectual property laws.
Any total or partial reproduction of this content is strictly prohibited and may constitute an infringement of copyright.
11. APPLICABLE LAW – LANGUAGE
11.1 These General Terms and Conditions and the transactions resulting from them are governed by and subject to French law.
11.2 These General Terms and Conditions are written in French. In the event that they are translated into one or more foreign languages, only the French text shall prevail in the event of a dispute.
